By accessing or using the Factured application (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by Factured, LLC (“Company,” “we,” “us,” or “our”), located at 1158 NE Lincoln St., Roseburg, OR 97470.

2. Description of Service

Factured provides equipment serial number decoding, age calculation, warranty information, recall alerts, and related equipment data services. The Service includes:

  • Serial number scanning and decoding
  • Equipment age and manufacturing date identification
  • Warranty status information
  • Recall alert notifications
  • Equipment specifications and data
  • Report generation and history tracking

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate or infringe upon the rights of others
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to the Service or related systems

The Service and its original content, features, and functionality are owned by Factured, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written permission.

6. User-Generated Content

You retain ownership of any content you submit to the Service, including serial numbers, equipment data, and reports. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

You represent and warrant that you have all necessary rights to submit such content and that your content does not violate any third-party rights or applicable laws.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Equipment data, recall information, or warranty status will be complete or current
  • Any defects in the Service will be corrected

Equipment information provided by the Service is for informational purposes only. We recommend verifying all critical information with manufacturers and authorized dealers.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FACTURED, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Indemnification

You agree to indemnify, defend, and hold harmless Factured LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Third-Party Services

The Service may contain links to third-party websites or services, including manufacturer websites and recall databases. We are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their terms and conditions.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Douglas County, Oregon.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the Service after any changes constitute acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
